Feds Move to Enhance Power to Seek Customer Data From ISPs
The government can subpoena communications records from ISPs. This much is not in dispute. Much like a wire tap, the FBI has the right to receive material indicating that a crime has been committed. The interesting question is: does your ISP have a right to challenge the government's request? That is the subject of a dispute between an unnamed ISP (and its counsel, the ACLU) and the federal government.
